On 30 March, Meta announced that it will move from using ‘contractual necessity’ as the legal basis for collecting and processing user data for behavioural advertising purposes in the EU to ‘legitimate interest’. This move, which comes following the Irish Data Protection Authority decision finding Meta’s reliance on ‘contractual necessity’ unlawful, will reportedly provide users with the ability to opt out of behavioural advertising on Facebook and Instagram.

Also in March, the Austrian regulator found that a website’s use of Meta Pixel and Facebook Login violated the GDPR and was incompatible with the Schrems II ruling. This decision follows those made by several EU regulators last year finding the use of Google Analytics unlawful in the EU and could mean that EU website providers are found in breach of GDPR for using US-based digital services in the future.
