On 4 December 2020, the Directive on representative action for the protection of the collective interests of consumers (“collective redress”) was formally adopted in the EU. The new law is part of the New Deal for Consumers package, presented in April 2018 in response to the Dieselgate scandal. The new law will make collective redress available across the EU – and also cross-border.

Representative actions can be made against companies found in breach of EU advertising related laws:  

  • the General Data Protection Regulation
  • the Misleading and Comparative Advertising Directive
  • the Audiovisual Media Services Directive, and
  • the Unfair Commercial Practices Directive.
