In November, the European Commission launched a public consultation as part of its ‘fitness check’ of EU consumer laws, seeking to assess whether current rules ensure a high level of consumer protection in the digital age.

The consultation is part of the ‘New Consumer Agenda’ presented in 2020 and focuses on assessing whether changes are necessary to the Unfair Commercial Practices Directive, the Consumer Rights Directive and the Unfair Contract Terms Directive.

WFA drafted a position paper in response to the public consultation, advocating that current legislation provides a robust framework to protect consumers from misleading, harmful or intrusive advertising practices, and that the focus should therefore be on effective enforcement. WFA also argues that self-regulatory efforts effectively complement existing rules. You can download the document below.
