A WFA benchmark on the use of Meta Pixel in response to recent regulatory decisions finding its use in breach of the GDPR

In March 2023, the Austrian data protection authority (the DSB) ruled that a website operators' use of Meta Pixel results in the unlawful transfer of personal data to the US, in breach of the 2020 ‘Schrems II’ ruling and GDPR. In May, the Irish data protection authority fined Meta €1.2 billion for unlawfully transferring the personal data of EU citizens to the US on the basis of Standard Contractual Clauses (SCCs). It also found that Meta Ireland's supplementary measures (organisational, technical and contractual) were insufficient to ensure an essentially equivalent protection of personal data of EU citizens in the US.
